American Button Machine Store Policies
The use of this site is governed by the policies, terms, and conditions set forth below. Your use of this site, including the submission of purchase orders, indicates your acceptance of these terms and conditions. These terms and conditions supercede any subsequent terms or conditions included with any purchase order. Please Note: A button machine (various sizes available) is required to assemble all supplies unless otherwise noted. Hours of operation are Monday through Friday, 8am-5pm, Central Standard Time.
Security: Our website is secure. We use the Secure Socket Layer Protocol to ensure that ordering information is encrypted and sent directly to us. Of course you can place your order over the telephone by calling 972-985-5074 or e-mailing us at Sales@AmericanButtonMachines.com.
Payment Acceptance: We accept Visa, Mastercard, American Express, Discover, and Pay Pal along with money orders, bank wire transfers and personal checks. We are happy to accept purchase orders from schools and government institutions. All payments must be in US funds. If paying by credit card, please be sure to provide the exact name, billing address, and telephone number as they appear on the credit card statement. Incorrect information may cause a delay in processing an order. Credit card orders that are shipped to an address other than the billing address listed with the credit card company require a temporary, alternate shipping note added to the credit card account. Pay Pal orders must ship to the address on file with Pay Pal. If you choose to pay by check and your check is dishonored, you agree to pay a processing fee of $30, or any higher amount allowed by law, and we may electronically debit or draft your account for this fee. Also, if your check is returned for insufficient or uncollected funds, your check may be electronically re-presented for payment. A $5.00 late fee or 1 1/2% interest (whichever is greater) per month is charged on past due balances.
Sales Tax: Shipments to Texas and Wisconsin may be subject to sales tax. If you are a non-taxable customer, please fax a completed Tax Resale Certificate Form to us at 949-203-0493.
Shipment Policy: All in-stock orders are shipped M-F within 24-48 hours of placement, however most all orders ship the same day they are placed. Orders received after 12 pm CST may not ship the same day. Please call our office if your order requires immediate attention. We offer free ground freight within the continental United States, excluding Alaska and Hawaii, on select products. Orders are shipped via UPS, USPS or by other freight companies out of several warehouses across the country. Published transit times reflect standard business days and do not include weekends. We are not responsible for late or misdirected shipments caused by a carrier. The customer is responsible for all freight charges for any refused, canceled, or non-deliverable shipments, including improper ordering. UPS charges to correct an incorrect address. Please be careful that your address is complete and correct. If you accidentally provide us with an incorrect shipping address and UPS has to correct it for proper delivery, there will be a $15 charge to correct the address and your delivery may be delayed. At our discretion, and cost, we may choose to upgrade your shipping service from USPS Priority Mail to UPS Ground service. Your order may also be selected at our discretion to ship signature required. To facilitate the fastest possible shipping of your order, identical button components may be shipped in bulk quantities. Orders are shipped FOB Origin and we are not responsible for items delayed, lost or damaged in transit. We will always assist customers with claims against a carrier for lost or damaged shipments. All claims regarding shortage or product defect must be made within 30 days of shipment. All claims regarding damage to products during transit must be made within 2 days of receipt. If damaged, customer must keep all packaging materials for carrier inspection. If requested, customers must take damaged product to local post office for inspection. United Parcel Service (UPS) includes $100 of free insurance on each shipment. Customers have the opportunity to purchase additional insurance at the time of checkout. In many instances the United States Postal Service (USPS) does not include any insurance or tracking numbers and those services must be purchased during checkout. We strongly suggest you choose UPS as your shipping method as USPS damage/lost claims can take 30–90 days to complete.
International Orders: We ship anywhere in the world. We have no control over import taxes, duties, brokerage fees or Customs charges. These fees are calculated by the receiver’s country. These fees are additional to any shipping quote and payable upon delivery of your order.
Warranty: Please Note: We stand behind everything we sell. We offer a free lifetime warranty against defects on all of our pinback button making machines. Repairs not subject to warranty coverage, such as abuse and misuse, may require a repair charge unless covered by our No Questions Asked Ultimate Extended Warranty. Freight cost to and from the factory is the customer’s responsibility. Seller makes no warranties whether of merchantability, fitness for a particular purpose, workmanlike quality or otherwise, expressed or implied, arising by law or otherwise concerning said goods or services. Unless otherwise noted paper cutters have a 90 day warranty against manufacturer defects. Seller shall not be held liable for any damages arising out of the purpose or use of the goods or services. The receipt of goods or services upon delivery shall constitute a waiver of all liability for claims for consequential damages. Buyer’s sole and exclusive remedy and Seller’s sole and exclusive liability shall be limited to, at Seller’s option; repair, replacement or refund of any non-conforming goods. This warranty does not cover normal wear of parts, cosmetic damage, negligent use/ misuse of the product, use contrary to operating instructions or alteration by any person other than our factory service center.
Order Policy: We reserve the right to limit and prohibit any sale at our discretion. We may require additional verification or information before accepting any order. Orders cannot be cancelled or modified once they are in process. Sales prices are valid for new orders only. Subscriptions to our Build-a-Button Online Design Center begin immediately on the day an order is placed and/or shipped and are valid strictly for the consecutive days that follow the purchase date.
Reviews: American Button Machines reviews are helpful for a number of reasons. The most obvious being they can help a newcomer determine what will best fit their needs & feel certain their money will be well spent. Customers may post a review of every product they have purchased from us online and receive 250 ABM Reward Points (since the program’s inception) for each review. All reward points can be used as a price discount towards a future purchase. We only allow “verified” reviews posted on our site and customers are limited to one review (and single 250 point reward) per product. In this way we can ensure the genuineness of our published reviews for other potential consumers.
Returns and Claims: All claims must be made within 30 days of shipment. Returns must include a Return Merchandise Authorization Number (RMA#) clearly marked on the outside of the shipping box. Without this number, packages will be refused and returned to the customer at their expense. For verification purposes, the package must be shipped back to us with a carrier that can provide a tracking number. Returns must be requested within 30 days from the ship date and be in new condition and in the original packaging and quantity. Non-defective returns may be subject to a 15% restocking fee or $9.99 whichever is greater. Original shipping charges will be deducted on returns for orders shipped under a free shipping offer. Customers are responsible for freight charges on all returned merchandise. Special order merchandise is not returnable. Shipping charges and other fees or charges are not refundable. Opened or tampered-with software is non-returnable. Bulk button supplies are packaged by weight, due to the characteristics of metal they have a 5% tolerance in quantity or rejects. Repair costs must be paid in full prior to the return of customer equipment. Standard late fees will apply to any outstanding balance past 30 days. If payment is not made within 90 days of service, equipment will be donated or sold for the repair amount due.
Typographical Errors: We are not responsible for typographical or illustrative errors. In the event a product is listed at an incorrect price or with incorrect information due to a typographical or system error, we have the right to refuse, cancel (or adjust with customer approval) any order. American Button Machines reserves the right to make improvements, design and specification changes to its products without notice. Images or descriptions may differ slightly on upgraded and enhanced product features. Prices, specifications, and images are subject to change without notice.
General: American Button Machines makes no guarantee of availability of service and reserves the right to change, suspend, withdraw, or discontinue any feature or functionality of the website or service at any time. Our website, content and services are provided “As Is” and on an “As Available” basis. In no event will American Button Machines be liable for any damages, including, without limitation, direct, indirect, incidental, consequential, special, or punitive damages arising out of the use of or inability of American Button Machines products, services or content. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance, omission, error, deletion, interruption, defect, computer virus, delay in operation, transmission file corruption, destruction, network or system outage, theft, unauthorized access to, alteration of, or use of any product obtained from American Button Machines. American Button Machines does not represent or warrant that the functions contained on our sites will be uninterrupted or error-free, that the defects will be corrected, or that our sites or the servers that make the sites available are free of viruses or other harmful components. American Button Machines does not make any warranties or representations regarding the use of the materials on our sites in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. If you elected to purchase items from the ABM Design Marketplace, please follow the proceeding link to read additional terms and conditions for these products. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.
Jurisdiction and Venue: You agree that any legal action brought against American Button Machines or KB Industries Inc., shall be governed by the laws of the State of Texas without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made from the American Button Machines web sites shall be an appropriate court located in Collin County Texas. Each party consents to the exclusive jurisdiction of such court and waives any claim of lack of jurisdiction or forum non conveniens. We reserve the right to make changes to this site and our terms and conditions at any time.
